Terms of Use & Subscription Agreement

1. Acceptance of Terms
By downloading, installing, and using The Farm Hand mobile application (the “App”), whether on iOS (Apple App Store) or Android (Google Play Store), and by creating an account or using any of our services, you agree to be bound by these Terms of Use & Subscription Agreement (“Terms”). If you do not agree to these Terms, you must not use the App or our services.
2. License and Use
We grant you a limited, non-exclusive, non-transferable license to download and use the App on your personal device for your own non-commercial purposes, subject to these Terms. You may not copy, modify, distribute, sell, or lease any part of the App or its contents.
3. Subscription Plans & Free Trial
3.1 Free Trial
The Farm Hand offers a 15-day free trial to all new users upon initial download. During the free trial, you have access to the full features of the App at no cost. The free trial is limited to one trial per user account.
3.2 Subscription Tiers
After the 15-day free trial expires, continued access to the App requires an active paid subscription. We offer multiple subscription tiers (e.g., Basic, Premium, Pro) with varying features and pricing. Current pricing and features are displayed in the App at the time of purchase.
3.3 Automatic Renewal
Paid subscriptions automatically renew on a recurring monthly or annual basis (as selected at purchase) unless you cancel before the renewal date. You will be charged on the same day each month (or on the same date each year for annual plans).
4. Payment Processing
4.1 Payment Methods
We process payments through two methods:
- Apple In-App Purchase (iOS): For users on Apple devices, payment is processed through the Apple App Store using your Apple ID and payment method on file.
- Google Play Billing (Android): For users on Android devices, payment is processed through Google Play Store using your Google Account and payment method on file.
- Stripe (Web/App): For direct payments, we use Stripe as our payment processor. Your payment information is encrypted and processed securely.
4.2 Billing
Your subscription will be charged to your payment method on file at the beginning of each billing cycle. Charges will appear on your statement under “The Farm Hand” or similar branding.
5. Cancellation & Refund Policy
5.1 How to Cancel
You can cancel your subscription at any time. Cancellation methods depend on your platform:
- iOS: Go to Settings > [Your Name] > Subscriptions > The Farm Hand > Cancel
- Android: Go to Google Play > Account > Subscriptions > The Farm Hand > Cancel
- Stripe/Web: Log in to your account settings and manage subscription from the Billing section
5.2 Access After Cancellation
When you cancel your subscription, your access continues until the end of your current billing period. You will not be charged again after cancellation. For example, if you cancel on the 10th of the month with a monthly subscription that renews on the 20th, you will have access until the 20th.
5.3 No Refunds
All paid subscriptions are final and non-refundable. No refunds are issued for partial months, early cancellations, or unused portions of your subscription. Your access continues until the end of your current billing period, regardless of when you cancel.
5.4 Account Deletion
If you wish to delete your account entirely, you may submit a request via the App settings or contact us at [email protected]. Your data will be deleted in accordance with our Privacy Policy. Account deletion does not automatically cancel your subscription; you must cancel your subscription separately to stop recurring charges.
6. User Responsibilities
You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activity that occurs under your account
- Ensuring you have legal rights to any farm data you upload
- Complying with all applicable laws and regulations in your jurisdiction
7. Prohibited Uses
You agree not to:
- Use the App for any illegal or harmful purposes
- Attempt to hack, reverse engineer, or compromise the App's security
- Share your subscription with multiple users or attempt to circumvent payment requirements
- Upload malicious files or content that violates third-party rights
8. Intellectual Property
All content, features, and functionality of the App (including but not limited to software, code, design, text, graphics, and logos) are the exclusive property of The Farm Hand L.L.C. and are protected by international copyright, trademark, and other intellectual property laws.
9. Warranty Disclaimer
The App is provided “as is” without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or free from viruses or harmful components. Your use of the App is at your own risk.
10. Limitation of Liability
To the maximum extent permitted by law, The Farm Hand L.L.C. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use or inability to use the App, including loss of data or business interruption.
11. Third-Party Services
The App may integrate with third-party services (e.g., weather providers, farm equipment APIs). Your use of these services is governed by their respective terms and privacy policies. We are not responsible for any third-party service failures or data practices.
12. App Store Policies
Your use of the App is also subject to the terms and policies of the platform where you downloaded it (Apple App Store or Google Play Store). In the event of conflict between these Terms and platform-specific terms, platform terms may take precedence for transactions processed through that platform.
13. Privacy
Your use of the App is also governed by our Privacy Policy, which is available at https://thefarmhand.ai/privacy. Please review the Privacy Policy to understand our practices regarding data collection and use.
14. Modification of Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the App or our website. Your continued use of the App following any changes constitutes your acceptance of the modified Terms.
15. Suspension or Termination
We reserve the right to suspend or terminate your account and access to the App at any time, for any reason, including violation of these Terms or suspected fraudulent activity. Upon termination, your right to use the App ceases immediately.
16. Governing Law
These Terms are governed by and construed in accordance with the laws applicable to The Farm Hand L.L.C., without regard to its conflict of law principles.
